Portrait vouchers
1.1 Booking deposit
A refundable £25 booking deposit is required when arranging your photoshoot. Your booking will only be confirmed once the deposit has been paid.
The £25 deposit is credited towards your order and can be refunded once your online viewing gallery goes live. Most clients choose to use it as part payment towards their photographs, but if you decide not to place an order, the deposit will be refunded.
At least 72 hours’ notice is required to cancel or reschedule your photoshoot. If less than 72 hours’ notice is given, the booking deposit will become non-refundable.
1.2 Copyright
Copyright in all photographs, including ownership of the original materials, remains with Simon Withyman Photography at all times and worldwide, unless otherwise agreed in writing.
1.3 Voucher expiry
Photography vouchers are valid for 6 months from the date of purchase, unless otherwise stated.
1.4 Location + weather conditions
Photoshoots can take place at a location of your choice within Bristol and the surrounding areas, provided any necessary permissions can be obtained.
If you’re not sure where you’d like your photoshoot to take place, I’m happy to suggest locations to suit you and the type of photographs you’re looking for.
Locations more than 20 miles outside Bristol will incur a travel charge of 55p per mile.
If weather conditions are unsuitable, your photoshoot may be cancelled or rescheduled. Wherever possible, this will be discussed with you the day before your appointment, although in some circumstances a decision may need to be made on the morning of the shoot.
1.5 Viewing your gallery
Your photographs will be uploaded to a private online viewing gallery within 10 days of your photoshoot.
The photographs will be numbered to make ordering straightforward. Once your gallery is live, an early-bird price may be available if an order is placed within 3 weeks of the gallery going live.
If you’re interested in wall art or other printed products, home visits can be arranged where appropriate. This gives me the opportunity to offer advice on choosing products and framing that work well within your home.
Orders can take up to 4 weeks to complete, although most orders are ready within 2 weeks.
1.6 Refunds
Photography vouchers are non-refundable after 7 days from the date of purchase.
Once a photoshoot has taken place, refunds will not be available for orders that have already been placed.
Any changes to an order must be requested within 24 hours of the order being placed.
1.7 Digital files
Once digital files have been supplied, it is your responsibility to make sure they are securely backed up in more than one location.
I recommend keeping copies on a portable hard drive as well as using a reputable online cloud storage service.
While every reasonable effort is made to keep your photographs safely stored, Simon Withyman Photography cannot guarantee that digital files will be retained indefinitely.
1.7 Photographic style & technical issues
By booking a photoshoot, you acknowledge that you have viewed my portfolio and are happy with my photographic style.
There is therefore no right to reject photographs based solely on their style, composition or artistic interpretation.
If photographs are affected by a genuine technical problem, Simon Withyman Photography will, where appropriate, either reprint the affected images or arrange a replacement photoshoot.
1.7 Other
Some photoshoots may involve walking, climbing, uneven ground or other physical activity. You take part in these activities at your own risk.
Anyone under the age of 18 must be accompanied by a parent or legal guardian.
Commercial + business
2.1 Estimates
An estimate will be provided based on the initial brief and the photographic services required.
This may include, but is not limited to, fees for photography time, expenses, production, image usage and retouching.
Unless otherwise agreed in writing, all retouching will be carried out by Simon Withyman Photography and not by the client or a third party.
2.2 Additional fees
Photographic work outside the Bristol area or overseas may incur additional costs, including travel, accommodation, food and other reasonable expenses.
Any additional costs will be agreed between Simon Withyman Photography and the client before the work takes place and may be payable separately.
In the event of cancellation, expenses that have already been incurred or paid on behalf of the client may be non-refundable.
2.3 Payments
50% of the estimated fee, together with any agreed expenses and production costs, must be paid in advance of the photoshoot.
Any remaining balance is payable within 14 days of the invoice date.
If additional time, expenses or other costs are incurred as a result of changes to the original brief, the client will be responsible for these additional costs.
2.4 Right to a credit
Simon Withyman Photography must be credited on editorial uses, publications and other agreed uses where this is specified in the estimate.
2.5 Photographic style & technical issues
By commissioning Simon Withyman Photography, the client acknowledges that they have viewed the photographer’s portfolio and are happy with the photographic style.
There is therefore no right to reject photographs based solely on their style, composition or artistic interpretation.
If photographs are affected by a genuine technical problem, Simon Withyman Photography will, where appropriate, either reprint the affected images or arrange a replacement photoshoot.
2.6 Force majeure
Simon Withyman Photography reserves the right to alter or cancel a booking where circumstances beyond reasonable control make it impossible or impractical to carry out the agreed work.
In the unlikely event of technical failure or other circumstances preventing delivery of the agreed photographic services, liability will be limited to a refund of monies paid, excluding any non-refundable booking fees and expenses already incurred, including travel and production costs.
Simon Withyman Photography holds Public Liability and Professional Indemnity insurance.
Nothing in these terms affects your statutory rights.
Privacy policy
3.1 Mailing list
If you subscribe to the Simon Withyman Photography mailing list, you consent to your email address being stored and used to send you newsletters and other relevant communications.
The mailing list is managed through Mailchimp. Your information will not be shared with third parties except where necessary to provide this mailing-list service.
You can unsubscribe at any time using the unsubscribe link at the bottom of any newsletter.
Alternatively, you can email info@simonwithyman.com with “UNSUBSCRIBE” as the subject line, along with your name and email address.
Simon Withyman Photography takes reasonable steps to protect your personal information. In the unlikely event of a data breach affecting your personal information, you will be contacted where required.
3.2 Data protection rights
You have the right to request access to the personal information held about you and, where appropriate, to ask for your information to be corrected, updated or deleted.

3.3 Use of photographs
Simon Withyman Photography will always seek your permission before using photographs from your session or wedding on social media, online portfolios, in magazines or in advertising.
If you would prefer your photographs not to be used, I will always respect your wishes.
